Rental Contract

This Accommodation Rental Contract (the Contract) is between the Owner (Thomas Chamings and Anna Sowinska) and the person making the booking (the Guest). The Accommodation refers to Casa Terradets, Carrer Única 10, Gavet De La Conca, 25639 Lleida.

Payment of the total cost of the booking by the Guest indicates the acceptance of the Contract in full. All policies in the Contract are strictly enforced and it is the responsibility of the Guest and members of their group to be familiar with the policies before the start of the rental period.

1. Approved Guests
The Accommodation may only be occupied by the number of people indicated on the booking form, unless agreed in advance with the Owner. The maximum occupancy is 4 people, with a maximum number of 2 children aged 12-17 allowed. Bookings for children under the age of 12 are not accepted. The Guest making the booking must be 25 years or older.

If the Accommodation is used, in any way, by more than the approved number of people, this will constitute a breach of the Contract:

– The Guest and his/her group will be asked to leave the accommodation immediately.
– The Guest forfeits their right to a refund of any monies paid.

The Accommodation may only be used for holiday purposes and the Guest agrees not to use it for parties, or for illegal or commercial purposes, including subletting.

2. Acceptance of the Contract
When the Guest submits a booking request through the website booking form, the Guest will be asked to agree to accept the terms of the Contract. By clicking the website booking form “Reserve Now” button, the Guest is agreeing to abide by all the terms listed in the Contract without exception. The Contract between the Guest and the Owner arises when the total cost of the booking has been paid.

3. Payment
Full payment of the total cost of the booking as shown on the website booking form is required to reserve the Accommodation. The Guest can choose to pay for the booking by bank transfer payment or by card payment. All payments must be made in euros.

– If the Guest chooses to pay by card payment, then the chosen dates will be reserved immediately and status of the booking will be “confirmed”.
– If the Guest chooses to pay by bank transfer, then the status of the booking will be “pending” until payment has been received. Bank transfer payment must be initiated within 1 business day of submitting the website booking form. The reservation will be cancelled if the bank transfer payment is not received by the Owner within 3 business days.

The Accommodation prices do not include IEET (tourist tax for Catalunya). The IEET is 1.93 € per person per night. It is applicable for all guests age 17 and above and is charged for the first 7 nights of the stay only.

4. Cancellation
Bookings are non-refundable. However, should the Guest request to cancel their booking, the reservation period will be re-advertised and if it is successfully re-booked, the total cost of the booking will be refunded minus a 25 € administration fee. If the reservation period is only partially re-booked, the Guest will receive a refund for each night re-booked, minus a 25 € administration fee. All cancellation requests must be made in writing by emailing [email protected].

5. Arrival and Departure
Full details of the arrival procedure will be provided once payment has been received.

– Check-in time is no earlier than 3 pm and no later than 10pm on the arrival date.
– Check-out time is no later than 11am on the departure date.

It is a legal requirement in Catalunya for all guests to register with Mossos d’Esquadra (the Catalan Police) within 24 hours of arrival at the accommodation. To comply with this requirement, all guests will be asked to provide identification and address details upon arrival.

6. Pets
Pets are NOT permitted. Unauthorized occupancy with pets will result in the immediate eviction of the Guest and his/her group and the loss of all monies paid.

7. Smoking Policy
Smoking is NOT permitted inside the Accommodation. Smoking is permitted on the terrace in front of the accommodation but the Guest is responsible for any damage caused by the smoking including, but not limited to, stains, burns, odors and removal of debris.

8. No Tolerance Noise Policy
During the rental period, the Guest and his/her group agree to be respectful towards the other residents in the village. This includes not playing music outside of the Accommodation and keeping noise to appropriate levels especially during the evening and into the night. The Accommodation shares a courtyard with the Owner’s house and the Guest and his/her group are expected to keep noise to a minimum level between 10pm and 8am. Guests who cause a nuisance by producing excessive noise or with anti-social behaviour will be asked to vacate the property and will forfeit any monies paid.

9. Liability
The Owner is not responsible to the Guest or any member of his/her group for any loss or damage to persons or property resulting from the rental of the Accommodation. During the rental period, the Guest assumes responsibility for the Accommodation and its contents, as well as the personal property of the Guest and his/her group. Always lock the doors and windows when leaving the Accommodation. The Guest is responsible for lost key replacement costs.

The Owner recommends that the Guest takes out travel insurance against cancellation, loss of personal property and accidental damage to personal property. The Owner’s insurance policy does not cover theft of personal property from the Accommodation. Appropriate medical insurance that covers emergency treatment in Spain is also recommended.

10. Force Majeure
The Owner will make every effort to ensure that the Accommodation is available to the Guest during the booked rental period. If, due to circumstances beyond the Owner’s control this is not possible, the Owner’s liability is limited to the refund of all monies paid by the Guest.

11. Data Protection
The information that the Guest has provided to the Owner will be used to fulfil the rental Agreement. The Owner will not pass this information onto any other organisation other than to the insurer of the Accommodation.
